New Regulations Capping Benefits

New York Attorneys Help Clients Understand Regulations Capping Benefits

We keep up to date with the complex, evolving Workers’ Compensation laws

Throughout the United States, Workers’ Compensation laws continue to change and these changes generally do not help the injured worker. These changes can have drastic, immediate effects on disability and on-the-job injury benefits you are currently receiving or may need in the future. Many of these changes came with the New York State Workers’ Compensation Reform Bill of 2007, which put caps on the length of time and amount of Workers’ Compensation and Permanent Partial Disability benefits a person can receive. If your injury occurred prior to March 14th, 2007, this does not affect your claim and the benefits last your natural life or your return to the workforce. Our firm has joined forces to prevent further cuts to the Workers’ Compensation Law and in 2018 we were part of an effort to squash drastic cuts to the financial values of Schedule Loss of Use claims.

Our firm is dedicated to helping injured workers obtain full benefits under the law

In 2007 New York became a “capped state” by placing caps on the amount of time an injured worker can receive disability benefits. The maximum number of weeks the injured worker may recover is determined by computing their percentage loss of wage-earning capacity. Your loss of wage-earning capacity determination is based on what type of work you are potentially capable of performing, taking these other factors into consideration:

  • Medical conditions
  • Age
  • Education
  • Prior work history
  • Vocational Skills
  • Functional Capacity

Our Workers’ Compensation lawyers can help you seek gather pertinent records to assist us with building your case to maximize your Permanent Partial Disability benefits.
